We ship hundreds of these crates every year. Estes, or any other freight line, have never said they were not crated properly. There is 1 x 4 wood slats with 2" thick styrofoam cushioning.
Estes has shipped these for us for 2 or 3 years without an accident. Now, when there is an issue, they claim they are not packaged properly, and want to pay pennies because as they state " it is uncrated". This claim has been reviewed by management and we have explained our position several times. Estes continues to make no attempt to resolve the matter or pay for any portion of the lost shipment.
They claim the matter has been reviewed and they have thoroughly explained their position. This is not true. They claim the entire shipment is without value. The only responses we have received from them to our numerous attempts to communicate are as follows the portion in quotes is the entirety of the emails that I received :. Email 1: "You should have received the attached letter.
Email 3: " See attached RTV notifications. This is the entirety of their responses to this matter. I responded to both emails 2 and 3 and explained why the two items did have value as outlined in our complaint and that the one RTV in the portion that they highlighted specifically noted that the item was non defective. I also explained that there were two that listed other items that were clearly identified as non-defective. They have not responded to either of these messages other than via this complaint saying that the matter has been reviewed and is closed.
And their emails clearly do NOT thoroughly explain their position. It's a baffling position for them to say that 2 of 9 items were defective which I dispute that even 2 were and therefore all 9 items have no value. The shipment is lost. They have no basis to claim the 2 items had no value. One was specifically noted as item ok, package damaged. The other was three items and they can't prove which if any of them were damaged since the shipment is lost. Please see the attached claim that was submitted.
If you look at the four documents that list the items, you will see that 8 of the 9 items are listed as non defective. And we have explained our position on the one combo item that was marked by the end customer as defective that they have no way to prove the extent of the damage, if any, and therefore must pay it in full. Full compensation is due. And if they will not provide it, you need to significantly lower their BBB rating.
This is not an ethical company that would take advantage of their power over a small business and refuse to deal in good faith. The product condition is unknown at the time of our pickup to return. Return product doesn't hold the original value especially when the product is damaged or defective. This claim has been reviewed by upper management and remains declined. Estes admits they lost a pallet of products they were paid to deliver and are liable for its value.
But to excuse their liability, they incorrectly claim the shipment had no value. If I filed a damage claim for a delivered item, but I had lost it, they would deny my claim for failing to prove condition. They are liable for full value. Our non-defective returns are sold as new. Customers order sinks, decide if they like them and may return. Estes also claims to know the condition based on the RTV notices provided with the claim.
If the RTV notice is the standard, they must follow it. Their reasoning has changed now that they see 8 items are marked as non defective. This item is a polished natural stone sink. The value is not reduced by damaged packaging when we have spare packaging on hand. If I filed a claim for an item I received with damaged packaging, but the item was fine, Estes would deny my claim that the item had no value.
We explained its condition cannot be proven. Since the item is lost, they cannot prove which, if any, was defective and must assume full value. This is an insulting offer. We have clearly explained our position multiple times that 8 of the 9 items are NOT defective or damaged using the same criteria that Estes did. And the 9th item may have had some part defective, but cannot be considered to be fully defective because it consists of multiple items.
Estes has nothing to stand on to claim that the 9 items were damaged or defective. It is an excuse to get themselves out of their liability, which they are clearly trying to do as they finally admit they have liability even on damaged and defective items, which they have denied up to this point. There were difficulties surrounding the delivery of this shipment. We eventually dropped the trailer and the customer unloaded and we have since picked up our trailer. A claim form has been sent to the customer to file for any alleged damages. Thank you,. Estes Express Lines.

In order to receive the package someone over 18 has to be available to sign for it. I called them at 4pm, and was told the truck was about an hour away, not unusual with traffic. At I called back for get a better estimate about my delivery and was treated rudely by the gentleman that answered, I asked to speak to his supervisor who looked into my delayed delivery and said the truck was in my town and should be to my house very soon. After waisting my entire day I get a call from ESTES stating that they would not be delivering my package that day and would have to re-schedule.
Please advise the Estes freight bill number so we can look into this complainant. I've used Estes for 3 -4 years to ship the same product in the same type of crates. I had a recent shipment damaged, which was noted at the time of delivery. Their position is, after shipping the same product for years, it was not packaged properly.
They have offered to pay. Other freight companies have approved the crates and paid claims. We will need the Estes claim number to investigate this complainant. Customer Response. This claim was declined for improper packaging. A dealer sent a pallet of customer returns to us using Estes. They admit they lost the pallet.
We filed a claim for the value of the items and shipping. The pallet contained 9 items.
